‘Harry Richards Limited’ is a Limited company registered in England and Wales Registration No. 11280060. ’Harry Richards Photography’ and ‘Reportography’ are trading names of ‘Harry Richards Limited’ (hereafter known as HRL).

Payment // A non refundable Booking Deposit is required to reserve your date(s). Booking fees may be waived by HRL in writing. The Booking Deposit reserves the date(s) requested in the Booking Form and is non-refundable and non-transferable. Only when the Booking Deposit is paid will your date(s) become a confirmed booking. The remaining balance is due within 14 days of your invoice date. Full payments for additional products, including prints and albums, must be made at the time they are ordered through your Photohub.

Variation // No overtime charges will be incurred without the prior verbal or written consent of the client. When overtime is an additional two hours or more, the client will be responsible for additional travel or accommodation expenses incurred. Photohub Orders should be made within 3 months of date of receipt of the Full Selection or increases in the current price list will be charged to the Client.

Delivery // Portrait & Event Images are delivered within 5 working days unless 24 hour turnaround is requested in advance. Wedding Images are delivered within 30 working days.  Image Downloads will be available through the Photohub for at least 1 year or until they are removed from the server. You are licenced to print and share these images once your balancing payment has been received. All photograph sizes are nominal. Reasonable steps are taken to ensure compatibility, but it is possible the Photohub will not function fully on some devices. If you require full gallery password protection, please request in writing.

Creativity // HRL shall be granted creative and artistic licence in relation to the choice of locations and poses used. HRL’s assessment on photographic style and number of photographs taken shall be deemed correct. Due to changes of the weather and the availability and willingness of subjects, HRL will do his best to honour requested photographs but does not undertake to guarantee any specific photograph nor incorporate any specific background, location or group arrangement. HRL will provide a pleasing colour balance but cannot guarantee exact matching of colours, shades or textures.

Cooperation // The Client agrees to be cooperative in assisting the photographer(s) in making sure that the photography goes smoothly. HRL will make every effort to accommodate the requests of the Client for specific pictures, however the Client shall release HRL from any liability for failure to obtain a specific photograph or for failure of any key people to arrive in a timely manner to have their photograph taken. It is the Client’s responsibility to provide HRL with adequate time to photograph.

Food // Where the coverage is greater than six hours the Client agrees to provide the photographer(s) with a hot meal.

Usage // All photographic material shall be the exclusive property of HRL under the 1998 Copyright, Designs and Patents Act. The Client grants HRL the irrevocable and unrestricted right to use and alter the material for commercial, promotional, marketing, competition or other purposes without compensation and hereby release and shall hold harmless HRL from all claims or liability resulting from or associated with the use of the material. It is for the Client to obtain all necessary clearances from relevant third parties. HRL shall not be liable for any claims whatsoever resulting from alterations made to the material by the Client. Where possible, published images will be removed by HRL on request.

Substitutions // Where time allows, HRL will attempt to substitute another photographer to take the photographs in the event of illness, incapacity or other emergency on the part of Harry Richards. In the event of such substitution, HRL warrants that the photographer taking the photographs will be a competent professional. If however the Client would prefer to source their own photographer, then HRL will refund monies paid to HRL by the Client.

Liability // HRL takes the utmost care with respect to the exposure, processing and delivery of photographs & albums. However, in the event that HRL fails to comply with the terms of the agreement, for any reason, HRL’s liability is limited to the refund of all monies paid by the Client. The Client must ensure they have the necessary insurance to cover against any additional costs or risks. HRL will endeavour to store all photographs indefinitely but the Client is strongly advised to back up their images. Any complaints should be raised by the Client with HRL, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images. Full resolution files, prints & albums will be released when payment has been settled and cannot be refunded. A replacement will be provided if any digital file, album, frame or print proves to be faulty within 12 months of purchase.
